Restructuring is an important issue in the current economic climate. Institutions are facing uncertainty over reductions in their various funding streams with many institutions reporting a deficit in their annual accounts.
It is easy to see why institutions are in the position where they may need to consider options to restructure their workforce, whether in terms of numbers or changes to contractual terms. However, forthcoming changes contained in the Employment Rights Act on “fire and rehire”, substantially reducing the qualifying period needed to claim unfair dismissal and removing the cap on compensation will add further complications to reorganisations.
